1. Eligibility and Account Access
You may use KickLab only if you can form a legally binding contract and comply with these Terms and applicable law. You may be required to create an account and sign in using email/password or Google through Firebase Authentication to access some app features. You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account.
2. Permitted Use
KickLab is provided for training, charting, session review, and athlete management related to football specialists. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the app for your personal, team, or internal coaching use on Apple-authorized devices.
3. Apple Terms and Standard EULA
If you access the app through the Apple App Store, your use is also subject to Apple's applicable terms and the Apple Media Services Terms and Conditions. Unless a separate custom end user license applies and is enforceable, the Apple Standard End User License Agreement ("Standard EULA") will apply to the app to the extent required by Apple. If these Terms conflict with the Standard EULA on a point Apple requires, the Standard EULA controls for that point.
4. Premium Features, Trials, and Billing
Some features may be available only through a premium subscription. From time to time, we may offer a free trial or promotional access to premium features. If a free trial is offered, the terms presented at sign-up will control the duration, eligibility, and any automatic conversion to a paid subscription unless you cancel before the trial ends.
Subscription billing, payment collection, renewals, and cancellations are handled by Apple through your App Store account. Unless you cancel in accordance with Apple's rules, subscriptions may renew automatically for successive billing periods. Pricing, taxes, refund policies, and renewal timing are determined by Apple and/or applicable law.
5. Acceptable Use
You agree not to:
- Use the app in violation of law, regulation, or third-party rights.
- Reverse engineer, decompile, scrape, disrupt, or interfere with the app except where prohibited by law from restricting that activity.
- Circumvent subscription controls, advertising logic, account limits, or security measures.
- Upload or enter harmful, infringing, fraudulent, or abusive content.
- Use the service in a way that could damage, disable, or impair the experience for other users.
6. User Content and Local Data
You retain rights to the training data, notes, profile details, and other content you create in the app, subject to the rights needed for us and our service providers to operate the service. You represent that you have the rights needed to use any profile photos, athlete details, video, or other materials you add.
The app is designed to store session data, athlete profiles, and profile photos primarily on your device. You are responsible for local device security, backups, and controlling access when coach mode is used to manage multiple athlete profiles on one device.
7. No Athletic Performance Guarantee
KickLab is a training and workflow tool only. We do not guarantee athletic improvement, recruiting outcomes, roster status, scholarship opportunities, injury prevention, or any specific performance result. Training decisions, coaching decisions, and physical activity remain your responsibility.
8. Service Changes and Availability
We may add, remove, suspend, or modify features, including premium features, free features, rewarded ads, analytics, or integrations, at any time. We do not guarantee that the app or any feature will always be available, uninterrupted, or error-free.
9. Termination and Suspension
We may suspend or terminate your access to all or part of the service if we reasonably believe you violated these Terms, created risk for the app or other users, or if continued access is no longer commercially or technically feasible. You may stop using the app at any time and may cancel subscriptions through Apple. Sections that by their nature should survive termination will survive.
10. Disclaimers
To the maximum extent permitted by law, the app and related materials are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, Daxon Jaggersand its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenues, goodwill, or business opportunities arising out of or related to your use of the app. Our total liability for claims arising out of or related to the service will not exceed the greater of the amount you paid for the app in the 12 months before the claim arose or US$50.
12. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Daxon Jaggers and its affiliates, officers, employees, contractors, and agents from claims, damages, losses, and expenses arising from your misuse of the app, your violation of these Terms, or your infringement of another party's rights.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice through the app, the website, or other reasonable means. By continuing to use the service after updated Terms become effective, you agree to the revised Terms.
14. Governing Law
These Terms are governed by the laws of the jurisdiction where Daxon Jaggers is organized, excluding conflict of laws principles, unless applicable law requires otherwise. You should edit this section before launch to insert your preferred governing law and venue language.
